The new framework model of the individual employment contract
Order no. 2171/2022 approving the framework model of the individual employment contract ("Order 2171/2022") was published in the Romanian Official Gazette no. 1180 of 9 December 2022 and entered into force on the same date.
Order 2171/2022 implements the provisions of Law no. 283/2022 which amended the Labor Code. The following is a summary of the main changes:
- For those employees that do not have a fixed place of work, the contract will contain provisions regarding the amount of additional benefits (monetary or in kind) to which the employee is entitled and the means of ensuring and/or reimbursement of transport by the employer;
- The means used for salary payment must be expressly indicated in the contract;
- Employers will have the right to grant to the employees benefits such as private medical insurance, additional contributions to the voluntary or occupational pension of the employee, as the case may be;
- The new framework model requires that, in addition to the conditions for performing and compensating overtime, the amount of the overtime allowance should be mentioned as well;
- A new section regarding the conditions in which professional training is offered by the employer is introduced;
- The new framework model provides that the job-specific risks will be provided in the risk assessments of the workplace and in the identification sheet of occupational risk factors.
- A new section in which the applicable collective labor agreement is identified, is introduced.
