Nicoleta is a Managing Associate with Băncilă, Diaconu și Asociații SPRL and a member of the Bucharest Bar.
She holds an LLB degree from Titu Maiorescu University – Law Faculty in Bucharest and a Master degree in Labor Law from Bucharest University – Law Faculty.
She joined Băncilă, Diaconu și Asociații SPRL in 2006 after working in the legal department of a major cigarettes manufacturer for almost 3 years.
Nicoleta provides legal assistance in the following main areas: data protection, labor law, corporate and commercial, M&A, telecommunications.
In the area of data protection, inter alia, Nicoleta advises the clients on performing due diligence and risk assessments to determine the level of compliance with the legal framework by the data controllers or by the third party services providers, designing, drafting, reviewing and updating privacy policies and procedures in relation to the obligations established in this field by the applicable legislation.
Her practice includes advising clients on all aspects of labor law, such as drafting of employment agreements; collective negotiations; individual or collective dismissals; transfer of employees; international mobility; disciplinary procedures; health and safety regulations; vocational training; drafting of internal regulations and collective bargaining agreements; assistance during inspections from labor authorities.
She acquired extensive experience in the corporate and commercial area by advising clients on day-to-day legal matters and corporate governance aspects. Nicoleta assisted in the negotiation and implementation of commercial transactions, the review and drafting of complex commercial agreements and the conduct of due diligence projects.
Her practice in the telecommunications field includes providing advice on the legal framework, obtaining authorizations and licenses from the National Authority for Management and Regulation in Communications, drafting, reviewing and negotiating agreements with telecom operators.
